which any such way machinery or equipment is fabricated, assembled or used, (v) contacting or engaging in discussions with any third parties, including landowners, power purchasers,
customers, suppliers or others, in connection with any matters disclosed in Confidential Information, or (vi) using Confidential Information for any purpose other than as expressly contemplated
by the Non Disclosure Agreement, executed prior to this disclosure.
